Article 1 – The organising company

La Société pour l’Expansion des Ventes des Produits Agricoles et Alimentaires – SOPEXA, a joint stock company with executive and supervisory boards, registered with the Trade and Companies Register (RCS) in Paris, reg. No. 775 670 110 R.C.S., with the address 28, rue Feydeau, 75002 PARIS (‘the Organiser’) is running a free promotion within the framework of a public service delegation entrusted by the Ministry of Agriculture and Food, via Instagram, from  20 December 2018 until 25 December 2018 included.

It is stated that Instagram is not the organising company and / or sponsor of the promotion and therefore cannot be held responsible for any problem related to the promotion.

Article 2 – Conditions of participation

The promotion is open to any persons in the world who are at least 18 (eighteen) years old at the date of participation. Employees of the Organiser and their respective families, also any persons involved directly or indirectly with the design, organisation and/or management of the promotion are not eligible to participate

To enter the promotion, participants must have an Instagram account and follow the account @frenchfoodandbeverages on Instagram.

Only one entry per participant is authorised. Its is forbidden to participate from multiple Instagram or other accounts. The participation is personal ; it is not allowed to participate from another person’s Instagram account.

By entering the promotion, participants agree to accept these rules fully and unconditionally,  and accept the draw principle.

Article 3 – Terms of participation

Any participation can be entered via Internet only, through the social network of Instagram.

At the opening of the promotion, the organising Company will post a photo on the  @frenchfoodandbeverages account announcing the start of the contest. The participation is done  :

  • By subscribing to the account @frenchfoodandbeverages on Instagram ; and
  • By mentioning a friend in comment of the announcement post of the promotion published on the  @frenchfoodandbeverages account.

No other means of participation will be accepted. Any participation which is incomplete or not in conformity with the present regulation will not be taken into account and cannot be the object of any claim. In particular, the comment on the photo on the account @frenchfoodandbeverages must be made no later than the last day of the promotion to validate the participation.

Article 4 – Exclusion of  participation

The publications must be in keeping with the theme of the promotion and comply with the current legislation ; they may not infringe public order or offend public morality. In the event of non-compliance, the publications will be automatically removed from the promotion. In addition, any publication including comments or images denigrating the promotion, France, French products, the Organising Company or, in general any unethical remarks will be excluded from the contest.

The Organising Company reserves the right to delete, without notice, any publication of pornographic or discriminatory nature, any publication inciting violence or not in keeping with the theme or requirements of the promotion.

Under no circumstance may the Organising Company be held responsible, even partially, for the publications made by the participants nor for their removal.

Article 5 – Prizes

The prizes of the promotion are 3(three) baskets « Regions of France » with a unit value of approx. 133,81€.

Each prize is strictly  nominative.

Article 6 – Changes to the prizes by the Organising Company

In case of force majeure or substantial change by the supplier in the  purchase price of the prize, the Organising Company reserves the right to substitute the prize won by a prize of similar nature and value without possible engagement of the responsibility of the Organising Company.

The prize cannot, under any circumstances, be exchanged for its value in cash or against any other prize.

Article 7 – Method of designation and allocation of prizes to the winners

A draw will be held on 26 December 2018.

This draw will determine the 3 (three) prize winners amongst all participants gagnants who have mentioned their friend on the announcement photo of the promotion and having respected the terms and conditions of the promotion.

The winners of the draw will be named and identified by their usual name or Instagram nickname which they accept from now on by participating. The announcement of the winners will be made in the « story » of @frenchfoodandbeverages with the mention of their usual name or Instagram nickname.

The winners will be contacted by the Organising Company by private message on Instagram in the week following the end of the promotion. Winners must reply by private message within 5 days from the date of the message informing them of their prize to confirm their surname, first name and postal address. Failing response within 5 days or in case of incomplete response, the  winner will be considered to have waived his prize.

The winners will receive their prize by post.

Any prize that cannot be distributed for any reason beyond the control of the Organising Company and, in particular, for any difficulties encountered in contacting the winners,  will remain the property of the Organising Company and may be re-attributed to another participant drawn from valid posts. The Organising Company cannot be held liable in case of deterioration or in the event of a problem occurring during the delivery of the prize by mail.

The Organising Company reserves the right to request proof of the prize winners’ personal details and postal address. The winners give their permission to verify the authenticity of all details given when submitting their entry to the promotion. All false indications of identity or address will automatically result in the disqualification of the participation.

Article 8 – Changes to the promotion

The Organising Company reserves the right to extend this promotion, as well as to postpone the deadline for informing the winners, if the circumstances so require, without incurring any liability.

Article 9 – Consent to publish

The Organising Company reserves the right to us the names of the participants and the winners without any compensation.

The participant authorises the Organising Company, by participating in this promotion, to reproduce, represent, use and distribute his profile picture posted on his Instagram account. The participant acknowledges that the transmission of these rights will not give rise to the payment of any compensation or consideration. The participant guarantees that he is not bound by an exclusive contract concerning the use of his image or his name.

Each winner accepts in advance the use of his name, first name or Instagram identifier on any support whatsoever, for advertising or other purposes, on the Internet or not, for a maximum of 1 year, without restriction of place or reserve ; this use does will not give entitlement to any benefit other that the allocation of their prize.

Article 10 – Responsibilities

The Organising Company cannot be held liable if, in the event of force majeure, the promotion is to be cancelled, extended or closed early. Neither can the Organising Company be held liable in the event of any technical of telecommunications problems, problems with the distribution of prizes, or any other events beyond their control which render it impossible to redeem the prizes.

Furthermore, the Organising Company assumes no responsibility for the content of the publications of the participants. The Organising Company has the right to eliminate the candidate(s) in the event of partial or total non-respect of this regulation.

Article 11 – Personal information

In accordance with the RGPD and the Data Protection Act of 06 January 1978, the participants have the right to access, rectify or delete information concerning them and to oppose the collection of this information, which may be exercised on a simple written request to the address of the promotion indicated in article 1.

In case of exercise of the right of opposition before the end of the promotion, the participant renounces his participation.

Article 12 –Rules, terms and conditions

By entering the promotion, participants agree to be bound by the Rules and Terms and Conditions as detailed above. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

No correspondence or discussion regarding the Promotion Rules, Terms and Conditions or organisation can be entered into.

In the event of fraud perpetrated as part of the Promotion, the Organiser reserves the right to prosecute.

The Organising Company reserves the right to modify all or part of these Terms and Conditions, in particular to respect any new legislation and / or applicable regulations.
